Terms of Use
These Terms of Use (the “Terms”) set the conditions for using the iPhone app “Tiny Voyages” (the “app”), provided by foco apps (“we”, “us”). By using the app, you agree to these Terms. The Terms are written in English and Japanese. If the two differ, the English version prevails. The legal notice under Japan’s Specified Commercial Transactions Act is governed by its Japanese version.
1. The app
- The app is a focus timer. While you focus, your time becomes a trip to a famous place in the world, and you receive a postcard and a record of the trip when you finish.
- The scenes and postcards are our own illustrations of places. Place names are used only to say which place is shown. We are not affiliated with, sponsored by or endorsed by the owners or managers of these places.
- The app is a tool to help you focus. We do not promise any particular result, such as better focus, grades or health.
- For the app obtained from the App Store, Apple’s Licensed Application End User License Agreement (standard EULA) also applies. If it conflicts with these Terms, these Terms prevail to the extent the law allows.
2. Tiny Voyages Pro
- Tiny Voyages Pro (“Pro”) is offered as a yearly or monthly auto-renewing subscription, or as a one-time lifetime purchase. Prices and periods are shown on the purchase screen before you buy.
- A subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. After any free trial or discounted period, it renews at the regular price shown at purchase. Cancel in your Apple Account subscription settings (iPhone Settings → your name → Subscriptions). After you cancel, you can use Pro until the end of the period you paid for. There are no refunds for partial periods.
- If the yearly plan offers a free trial, the App Store decides whether you can get it. Unless you cancel at least 24 hours before the trial ends, the yearly price is charged when the trial ends.
- The lifetime purchase lets you use Pro for as long as we provide the app. Buying it does not cancel a subscription you already have; cancel that in your Apple Account subscription settings.
- Apple handles payment and refunds under its own rules. We cannot give refunds directly. To ask for a refund, use Apple’s Report a Problem.
- Purchases belong to your Apple Account. Use Restore purchases in the app to bring Pro back on a device signed in with the same Apple Account.
- If you are a minor, please get permission from a parent or guardian before purchasing.
3. What stays with you
- Postcards come from the focus time you record. They are the same with or without Pro, and they are never sold. The app has no paid lotteries or in-app currency.
- If Pro ends (because you cancel, a payment does not go through or a purchase is refunded), your records and postcards stay. Pro-only destinations and features become unavailable. If you get Pro again, they come back into view as before, along with the data you kept.
- Stopping in the middle of a trip, skipping days or taking a break never takes away what you already have.
4. Your records and postcards
- The records and text you create in the app are yours. We do not receive them (see the Privacy Policy).
- You may save and share postcard images and videos from the app for personal, non-commercial purposes, including posting them on social media. Please do not sell them, use them in advertising, or use them in a way that suggests a place or its manager endorses you or us.
5. Blocking apps
- Blocking uses Apple’s Screen Time. It is free and works only while you allow Screen Time for the app.
- Blocking may not work in some cases, for example when Screen Time is restricted or because of how iOS behaves. Do not rely on it for anything where safety, health or money depends on not using an app.
6. iCloud and backups
- If you use iCloud, your records are kept in your own iCloud through Apple’s service. We cannot see or recover data in your iCloud.
- The app keeps backups on your device and lets you export all of your data. We recommend exporting from time to time, for example before you change devices.
7. Things you must not do
- Anything that breaks the law or public order
- Modifying, reverse engineering, copying or redistributing the app, except as the law allows
- Changing purchases, records or the time count by improper means
- Infringing the rights of us or others, or interfering with the operation of the app
8. Rights
The rights in the app’s program, scenes, illustrations, sounds and text belong to us or to their rightful owners. These Terms grant no rights beyond personal use of the app and the uses in section 4.
9. Changes and ending
- We may change the app’s content, add, change or retire destinations, or stop providing the app. Postcards and records you already received stay with you.
- If we plan to stop providing a paid service, we will tell you in the app as far in advance as we can.
10. Limits of liability
- We do not promise that the app will always work, be free of bugs or suit a particular purpose.
- If our slight negligence (negligence that is neither intentional nor gross) causes you damage, we are liable only for direct and ordinary damage, up to the greater of the amount you paid for the app in the 12 months before the damage occurred or 1,000 yen.
- These Terms do not limit consumer rights that the law of your country does not allow to be excluded.
11. Changes to these Terms
We may change these Terms in line with the law. Before a change takes effect, we will announce what is changing and when, on this page and, for important changes, in the app.
12. Governing law and courts
These Terms are governed by the laws of Japan. Any dispute about the app will be heard first, exclusively, by the district court with jurisdiction over our address. This does not prevent a consumer from bringing a claim in a court where they live, where the law allows it.
